Can I enter the country without a visa?

Non-Ukrainian citizens who fled Ukraine can enter Austria without a visa on humanitarian grounds or pass-through Austria to continue to their country of origin.

Can I get refugee status in the country?

Non-Ukrainian third-country nationals or stateless persons with international protection status or comparable national protection status granted before 24 February 2022 under Ukrainian law, who had to leave Ukraine due to the armed conflict as of 24 February 2022 have the right to apply for temporary protection. This applies to persons with asylum or complementary protection in Ukraine.

Moreover, third-country nationals with Ukrainian residence permit are not covered by the regulation. However, you can enter Austria for humanitarian reasons or travel through Austria to continue to your country of origin. You are legally a resident in Austria as long as you make serious efforts to return home and take all the necessary steps without undue delay. In this case, your legal residence lasts until you can travel on to your country of origin. If you need support on your journey home, you can contact the return counseling service of the Federal Agency for Care and Support Services (BBU).

How long can I stay in the country?

Third-country nationals, who do not have asylum or a comparable status in Ukraine, are legally resident in Austria until they can return to their country of origin.
